The initial contact with me is free of charge. Fees only become payable once they have been agreed and the parties involved have agreed to mediate.
Get in touch by phone or email. When we speak I will ask you about your case and tell you whether I can help and if so what happens next. Every case I mediate is different. Many do not have a monetary value so it is not possible for me to say what the fee will be at the beginning. I will need to contact the other side to see if they will agree to mediation after which I will discuss your case with you and your opponent and then suggest a figure which will reflect the nature of the case and the time involved.
Lots of mediators provide a fee scale on their websites which are based on the monetary value of the claim which I do not think is right. Every case is different and has different aspects which may affect the amount of time involved in the mediation. I can assure anyone who uses my services that the fee I suggest will be reasonable and competitive.
After Fees Are Agreed
Once the fees are agreed I will send a mediation agreement to the parties to be signed and returned to me in the stamped addressed envelope provided. At the same time the parties should each send payment of 50% of the agreed fee. Once the parties have returned the signed agreement and have made payment of the fees I will arrange a date and venue for the mediation.
The mediation must take place at a venue where the parties feel comfortable and there is privacy. If solicitors are involved the mediation could take place at their offices if everyone agrees. Sometimes it will be necessary for me to hire rooms for the mediation. The cost for doing this is generally very reasonable. If this happens, the parties will each pay 50% of the cost. In some cases (e.g. workplace or landlord and tenant mediation), one party will pay all the mediation fees but this has to be negotiated.
If either party cancels the mediation within 5 clear days of the date, then I reserve the right to make a reasonable charge for the work completed in preparation for the mediation. This will be payable by the party who cancels. The rest of the fees paid will be refunded.
